These Terms and Conditions of Sale
and Use ("T&C") govern access to and use of the Diego
mobile application ("the
Application"), available on iOS and Android platforms. By accessing and
using the Application,
the user expressly accepts all the terms herein.
I. ACCESS TO THE APPLICATION
1. Target Audience
The Application is strictly reserved for individuals of legal age. All users must be at least 18
years old.
2. Access
Access to the Application is provided via the iOS and Android platforms.
Diego reserves the
right to suspend or limit access to any user who does not comply with these
terms.
II. SUBSCRIPTION AND PRICING
1. Subscription Plans
◦ Weekly Subscription: €7.99 per week.
◦ Monthly Subscription: €24.99 per month.
These subscriptions are offered
"without commitment" and automatically renew
unless canceled by the user in accordance
with these terms.
2. Payment Terms
Subscription payments are processed through in-app purchases via the
App Store (iOS) or
Google Play (Android), in accordance with the rules of these platforms. Any price
changes
will be notified to the user through the Application.
III. CANCELLATION, TERMINATION, AND REFUND
1. Cancellation Procedure
The user can cancel their subscription at any time via their account settings on the App Store
or
Google Play. Upon cancellation, access to premium features will continue until the end of
the
already paid period.
2. Termination by Diego
Diego reserves the right to suspend or terminate access to the
Application in case of non-
compliance with these T&C or for any abusive behavior,
including:
◦ Fraudulent use,
◦ Violation of these terms (e.g., misuse of artificial intelligence or unauthorized data
sharing).
In such cases, no refund will be issued.
3. Refund Policy
In the event of a technical issue preventing the use of the
Application or a proven billing
error, the user may contact customer service to request a refund.
Each request will be
reviewed on a case-by-case basis.
IV. DATA AND ARTIFICIAL INTELLIGENCE USAGE
1. SportMonks Data
The Application integrates and utilizes data from Third-Party API. The user acknowledges
that this
data is provided for informational purposes only and that no guarantee of accuracy
or completeness
is given.
2. Use of Artificial Intelligence
Diego employs artificial intelligence algorithms to
analyze data in real-time and generate
predictions and recommendations. These analyses do not
constitute financial advice or an
encouragement to engage in betting. The user remains fully
responsible for their decisions.
V. PERSONAL DATA PROTECTION
1. Data Collection and Use
In using the Application, Diego collects various personal data (e.g., name, email address,
browsing
data) to enhance the user experience, personalize services, and conduct statistical
analyses.
2. Data Sharing
The user's personal data will not be shared with third parties, except
as required by law or
with the user's explicit consent.
3. User Rights
In accordance with the General Data Protection Regulation (GDPR), the
user has the right to
access, rectify, delete, and object to the use of their data. To exercise

VI. LIABILITY AND WARRANTIES
1. Limitation of Liability
Diego commits to making all reasonable efforts to ensure the availability and reliability of
the
Application. However, the company cannot be held responsible for interruptions, errors,
or
inaccuracies in the data provided, nor for decisions made by the user based on the
information
transmitted.
2. Force Majeure
Diego shall not be held liable for any failure due to an event of
force majeure.
VII. LEGAL PROTECTION
1. Legal Disclaimer
These T&C protect Diego from any claims or legal actions resulting from the use of the
Application or the interpretation of the data provided. The user agrees to use the Application
in
compliance with applicable laws and assumes full responsibility for their decisions.
2. Modifications
Diego reserves the right to modify these T&C at any time. Changes
will be notified to users
via the Application or by email. Continued use of the Application
constitutes tacit
acceptance of the changes made.
VIII. APPLICABLE LAW AND JURISDICTION
These terms are governed by French law. Any dispute
relating to the interpretation or execution of
these T&C will be submitted to the competent
courts of the jurisdiction where Diego's headquarters
are located, namely Paris, France.
